Terms of Use for ChoreBuddy

ChoreBuddy · version 1.0

1. About ChoreBuddy and these Terms

ChoreBuddy is a digital service that helps families and other households organise tasks, chores, goals and rewards. The Service will initially be launched in Norway, Sweden and the United Kingdom.

The Service is provided by Ground Control Solutions AS, company registration number 934 177 924, Kamfjordåsen 64, 3227 Sandefjord, Norway (“ChoreBuddy”, “we”, “us” or “our”).

These Terms govern your access to and use of the ChoreBuddy app and its associated websites and services. By creating an adult account and accepting the Terms, you enter into an agreement with Ground Control Solutions AS.

Our Privacy Notice explains how we process personal data. It is available in the app and on our websites. The Privacy Notice does not form part of these contractual Terms, but you should read it before using the Service.

2. Who may create an account

You must be at least 18 years old and have the legal capacity to enter into this agreement to create a standard account (adult account). If you administer use of the Service by children, you must be their parent or guardian or have the necessary permission from the person with parental responsibility. You do not need to be a parent to create a household that does not include children.

Children and other restricted users may access the Service through a household administered by an adult. A restricted user does not enter into this agreement independently and must not accept the same Terms as an adult account holder. The adult who creates or invites the restricted user is responsible for ensuring that the use is authorised and appropriate.

You must not create a restricted user for another person without the necessary permission.

3. What the Service offers

ChoreBuddy may be used to:

Available features may depend on the account type, subscription, device, operating system, country or app version.

ChoreBuddy is an organisational tool. We do not perform chores, supervise whether activities are carried out safely or resolve disagreements between household members.

Rewards recorded in the app are private arrangements between household members. ChoreBuddy does not hold or transfer money and is not a party to the settlement of such rewards. The adult who creates a reward is responsible for ensuring that it is lawful, appropriate and understood by the members concerned.

4. Account and security

You must provide accurate and up-to-date information when creating and using your account. You are responsible for protecting passwords, sign-in links, devices and other access information. An adult account must not be shared with children or other people.

Contact us as soon as possible if you believe your account or device has been misused. We may ask you to verify your identity before restoring access or making security-related changes.

You must use your account responsibly and notify us if you suspect misuse. You do not automatically become responsible for another person's misuse merely because the activity was carried out through your account. Any liability will be determined under applicable law. We remain responsible for the security of the Service and for our own obligations as its provider.

5. Households, roles and responsibilities

Information and content in a household may be visible to other members of the same household, depending on their role and the relevant feature. Before inviting anyone, you must check that you are inviting the correct person and that you are entitled to share the information concerned.

A household may have roles with different permissions to create, amend, approve or delete content and administer members. An administrator is responsible for managing roles responsibly. When a member is removed from or leaves a household, their access to household content may end.

ChoreBuddy does not verify family relationships, caring responsibilities or internal arrangements between household members. The Service must not be used as the sole basis for decisions about a child's safety, health, care or finances.

6. Information and images you submit

You retain the rights to textual information and images you submit to ChoreBuddy (“User Content”). You grant us a limited, non-exclusive right to store, process, copy and display User Content to the extent necessary to provide, maintain and secure the Service in accordance with the agreement and the Privacy Notice. This right ends when the content is no longer required for those purposes, subject to backups, record-keeping requirements and statutory retention obligations.

The only type of file that may be uploaded is an image associated with a chore. Such an image may be viewed by all household members who have access to that chore. You must therefore ensure that the image is suitable for sharing with this group before uploading it.

You are responsible for having the right to record and share User Content. Take particular care with images and information concerning children and other people. Do not submit more information than is necessary for its purpose within the household.

You must not submit or upload content that:

We may remove or restrict access to content where necessary to comply with the law, protect users or enforce these Terms. Where possible and appropriate, we will notify the affected user.

Reporting, blocking and follow-up

You can report a user or specific content using the reporting feature in the safety section of the app settings. You can also contact us at safety@grnd-ctrl.no without using the app. State that your enquiry concerns ChoreBuddy and describe what you would like us to review. Include only information needed to understand the matter.

You can block another user in your active household and later unblock them in the same settings. Blocking limits which content from that user is displayed to you in that household. It does not remove the user from the household, change their role or access, or delete content for other members.

Reports are handled by ChoreBuddy's authorised system administrators, not automatically by the household administrator. We assess the report and may request further information. Depending on the circumstances, we may close the matter without action, remove or restrict access to content, restrict an account or take other appropriate steps in accordance with sections 6 and 13. A report does not automatically lead to content removal or a user being suspended. Use reporting in good faith; do not submit deliberately false or harassing reports.

7. Permitted use

You may use ChoreBuddy for private, non-commercial organisation of your household. You must comply with applicable law and respect other users.

You must not:

8. Availability, maintenance and changes to the Service

We work to keep ChoreBuddy available and operating as described, but the Service may be temporarily unavailable due to maintenance, security incidents, failures affecting suppliers or other operational circumstances. We will provide information about planned maintenance where reasonably possible.

We provide necessary updates to keep the Service secure and in conformity with the agreement. We may also change features to accommodate new operating systems, resolve technical issues or comply with changed legal or regulatory requirements. Such changes will be made at no additional cost to you and will be clearly explained. New, optional paid offerings require a separate agreement.

If a change has a more than minor adverse effect on your access to or use of the Service, we will give clear and reasonable advance notice on a durable medium where required by law. The notice will describe the change and any right you may have to terminate the agreement or retain the Service without the change.

You should install necessary updates to maintain security and functionality. Liability for a defect caused solely by failure to install an update will be determined under applicable law. Among other things, this requires us to have informed you about the update and the consequences of not installing it, allowed a reasonable time for installation and provided adequate installation instructions.

9. Trial period and subscription

When an adult account is created and its trial licence is activated, the account holder receives one free trial period of 30 consecutive days. The trial period runs from the time of activation and is not extended because the Service is not used.

No payment is required to start the trial. The trial does not automatically convert into a paid subscription, and you will not be charged unless you actively purchase a subscription through the in-app purchase flow.

Your subscription starts on the date the purchase is completed. If you subscribe before the free trial has ended, the trial ends at the same time. Unused trial days will not be carried over to the subscription or extend the subscription period.

When the trial period ends, an active subscription is required for continued access to subscription-only household features. Information in your account and household is not automatically deleted when the trial expires. Access may be restored by purchasing a valid subscription, subject to the retention and deletion rules described in the Privacy Notice.

The trial and any subsequent subscription are associated with the account holder's licence. The licence provides access to households using that licence, within the limits shown in the app.

You may choose between a monthly and an annual subscription. Both subscriptions automatically renew for another period of the same length until cancelled.

The current price, currency and any applicable taxes are shown in the Apple App Store or Google Play before you confirm the purchase. Prices may vary between countries and app stores. The information shown by the app store and in the purchase confirmation determines the price and subscription period for the particular purchase.

Before purchasing a subscription, you will also be given information about automatic renewal, included features and how to cancel the subscription.

Purchases made through the Apple App Store or Google Play are billed and administered through the relevant store. Payment method, renewal and the practical cancellation process are normally managed through your store account. The store's terms also apply where relevant, but they do not limit rights you have against us under mandatory law.

You can cancel your subscription using the subscription controls in the Apple App Store or Google Play. Cancellation takes effect in accordance with applicable law and the terms disclosed at purchase. You will normally retain access until the end of the period you have already paid for.

We may change the subscription price for future billing periods to reflect changes in the cost of providing the Service or in taxes and charges. The price will not change for a period you have already paid for. We will give reasonable advance notice of a price increase, including the new price, its effective date and information about cancellation. Consent will be obtained where required by law or the app store. Norwegian consumers are, among other things, entitled to terminate without charge from the effective date of an increase that exceeds the change in the Consumer Price Index. Other mandatory termination rights continue to apply.

The trial period does not replace any statutory right to cancel a subsequent subscription purchase. Information about the cancellation period, procedure and any lawful exceptions will be provided before purchase. Starting to use the Service does not by itself cause every cancellation right to be lost. You may contact us at post@grnd-ctrl.no about cancellation rights, subscription cancellation or refunds. The app store's practical payment and refund process does not limit any claim you have against us under the law.

10. Intellectual property rights

ChoreBuddy, including its software, design, graphics, trade marks and content supplied by us, is owned by Ground Control Solutions AS or our licensors and is protected by intellectual property law.

For the iOS app, Apple's Standard End User Licence Agreement (EULA) applies. The ChoreBuddy service Terms apply in addition and do not replace that licence agreement. On other platforms, you receive a personal, non-exclusive right to use the app on devices that you own or control, subject to the platform's permitted usage rules. Access to the Service is governed by the agreement, the trial period and the subscription. Your right to use the app may be restricted or ended on the grounds set out in section 13, but not arbitrarily. Mandatory consumer rights apply regardless of platform.

We may use feedback and suggestions to improve the Service without being required to pay you. This does not transfer ownership of your User Content.

11. Third-party services

ChoreBuddy may depend on third-party services, including operating systems, app stores, sign-in services, storage, email and push notifications. Some features may require you to comply with a third party's terms.

We remain responsible for providing ChoreBuddy in conformity with the agreement when we use subcontractors. A failure by a subcontractor does not automatically release us from liability. Separate services that you contract for directly with a third party are also subject to that agreement. You may still make claims against us concerning our provision of ChoreBuddy.

12. Defects and liability

If the Service is not provided as agreed, please contact us at post@grnd-ctrl.no and describe the problem. You may be entitled to have the problem remedied, receive a price reduction, terminate the agreement, receive compensation or exercise other remedies under applicable law concerning digital services.

ChoreBuddy is not a substitute for professional advice, payment services, safety equipment or supervision of children. Adults in the household must decide whether chores, rewards and activities are safe and suitable for each person.

Our liability for defects, delays and losses is governed by applicable law. These Terms do not limit statutory claims for compensation or other consumer rights. We do not exclude liability for wilful misconduct, gross negligence or any other liability that cannot lawfully be limited.

13. Suspension and termination

You may stop using ChoreBuddy at any time. You can request deletion of your account in the app or by emailing post@grnd-ctrl.no. The account deletion function is located on the same page as the options to create or join a household.

Before a standard account can be deleted, every household owned by the account must be deleted and the account must be removed as a member of every other household. This is necessary to resolve ownership, roles and content shared with other members before the account is closed. The same conditions apply when you request deletion by email.

A restricted user's account is deleted when the user is removed from the household to which the account belongs. The adult administering the household is responsible for ensuring that the correct user is removed.

The conditions for closing an account do not limit the right to request erasure of personal data under data protection law. Such requests are handled separately, including while the account remains associated with a household. Contact us if you are unable to complete the necessary steps in the app. Account deletion does not necessarily mean that all information in shared history or backups is deleted at the same time; this is explained in the Privacy Notice.

Deleting the app from your device does not necessarily cancel a subscription or delete your account.

A subscription must be cancelled through the purchase channel shown in your account. Account deletion and subscription cancellation are separate actions unless the app store expressly handles both.

We may temporarily suspend or terminate access if:

Where possible and appropriate, we will notify you and give you a reasonable opportunity to remedy the matter before suspension or termination. We may act without advance notice in cases of serious misuse, an urgent security risk or a legal requirement.

If we plan to discontinue the Service, we will give reasonable advance notice and provide information about the closure date, retrieval of content and settlement. Prepayments for a period during which we do not provide the Service will be refunded. You may contact us to retrieve content that you are legally entitled to obtain, including when the agreement ends.

When your account is closed, you lose the access associated with it. Processing and deletion of personal data after closure are described in the Privacy Notice. Closure does not extinguish claims that you already have against us. Provisions which by their nature are intended to survive closure will continue to apply, including provisions concerning rights, liability and disputes.

14. Changes to the Terms

We may update the Terms to correct language errors, clarify existing provisions, reflect lawful changes under sections 8 and 9 or comply with new legal requirements. This does not give us a general right to unilaterally change the essential subject matter of the agreement or introduce new payment obligations.

For material changes, we will give reasonable advance notice explaining the change, its effective date and your rights. We will obtain fresh acceptance where the change requires a new agreement. Refusal of amended Terms does not cause you to lose rights already accrued or statutory claims to continued supply or repayment. You may contact us to terminate the agreement and settle the account. Account deletion is not a condition for bringing such claims.

The active version and its effective date are shown at the beginning of this document. We retain earlier versions for record-keeping purposes.

15. Governing law and disputes

The agreement is governed by Norwegian law. If you are a consumer in Sweden or the United Kingdom, this does not limit mandatory consumer rights under the law applicable where you live.

If you have a complaint, please first contact us at post@grnd-ctrl.no. We will try to resolve the matter with you.

If we cannot agree, a Norwegian consumer may ask the Norwegian Consumer Authority (Forbrukertilsynet) to mediate. Where relevant, the matter may then be referred to the Norwegian Consumer Disputes Commission (Forbrukerklageutvalget) or the courts. A Swedish consumer may, where relevant, refer the matter to the Swedish National Board for Consumer Disputes (Allmänna reklamationsnämnden, ARN). A consumer in the United Kingdom may obtain guidance from public consumer services and use an appropriate dispute resolution body where one has jurisdiction over the matter. Disputes may be brought before the court determined by mandatory jurisdiction rules.
